The Commonwealth presented testimony from a police officer with extensive drug interdiction experience who believed he saw Mr. Montoya’s client exchange items she had retrieved from a window for money with two individuals. Both of these individuals were stopped with matching drugs. The officer further stated that when they approached she threw a bundle of drugs to the street. During their investigation Police recovered 3 additional bundles from the window that all matched what was recovered from the two buyers and discarded items. Notwithstanding the strong police testimony, Mr. Montoya was again successful in the courtroom when he obtained a not guilty in a mandatory minimum drug case for his client. The verdict was significant as he was able to overcame police testimony and raise a reasonable doubt to save his client from at least a one to two year mandatory sentence.
